NEW WEED ORDINANCES:
ORDINANCE NO. 283

AN ORDINANCE AMENDING IN ITS ENTIRETY
BAGGS MUNICIPAL CODE CHAPTER 8.20 - WEEDS

BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF placeCityBAGGS:

§ 8.20 of the Baggs Municipal Code is hereby amended in its entirety to read as follows:

     8.20.010  Definition
     “Weeds” are defined as the non-cultivated growth of vegetation without aesthetic or agricultural value.
     8.20.020  Removal - Required
It is the duty of any property owner or agent, having control of any lot or premises, to mow or otherwise destroy and remove all weeds twelve inches (12”) and taller that are present upon any such lot or premises, as well as upon any space between such property and the centerline of any street, and upon that portion of such property to the centerline of any alley adjoining said premises.

8.20.030  Refusal to comply - Notice
It is the duty of the officer appointed by the governing body to require compliance with this chapter. The owner or agent of any premises shall be held liable for such compliance; and if such person shall refuse or fail to destroy and remove any weeds upon any premises under his care and control, he shall be served with written notice requiring removal of such weeds within ten (10) business days from the receipt of such notice. Notice shall be considered to have been received by the owner or agent of any premises when personally delivered to them, or upon deposit of said notice in the U.S. Mail at the last known address of the owner or agent.
8.20.040  Removal by town - Penalty
Upon failure to comply with any notice given pursuant to Section 8.20.030, the Town may have such weeds destroyed and removed, charging the cost thereof as a special bill for refuse removal.  If the owner or agent does not allow removal of said weeds there shall be a fine for the first offense of $150; the minimum fine for the second offense shall be $200 and the minimum fine for the third offense shall be $250.  Each time that weeds on such premises require destruction and removal shall constitute a separate offense.


This ordinance becomes effective upon posting, passage and adoption by the Governing Body of the Town of CityBaggs, placeStateWyoming.
